Effective Date: 1st October 2026
These Terms of Use (the “Terms”) apply to your access and use of our mobile application “Oncely” (the “App”), our websites and web properties (including our landing pages, quizzes, results pages, paywalls and checkout pages), the private writing workspace in which you create your book, our blog, all related services, and the printed books and other printed products we produce and deliver to you (collectively the “Service“) provided by Extramile Limited, a company incorporated in Cyprus, company number ΗΕ 445953, whose registered office is located at Prodromou, 75, Oneworld Parkview House, Floor 4, 2063, Nicosia, Cyprus (“we”, “us”, “our” or the “Company”).
These Terms establish a legally binding contractual relationship between you and the Company. You must accept these Terms to create an account and to access or use the Service. If you do not have an account, you accept these Terms by using any part of the Service. If you do not accept these Terms, do not create an account or use the Service.
If you have any questions about the Terms or our Service, please contact us at support@oncely.app.
Depending on your location, the platform through which you access the Service, or other relevant factors, your subscription or purchase may be sold to you by Extramile's authorized Reseller and Seller of Record: Fulfilling Inc., a company incorporated in Delaware, USA, with its registered address at 1007 N Orange St., 4th Floor, Suite 1382, Wilmington, New Castle, DE 19801. Where your subscription or purchase is completed through Fulfilling Inc., this entity is your contractual counterparty for the commercial transaction and is directly responsible for billing, payment collection, subscription activation, and the management of refunds, customer support claims, and payment disputes.
Access to the Service is developed and provided via license by Extramile Limited. Both Extramile Limited and Fulfilling Inc. ensure the delivery and performance of the Service in accordance with these Terms, and each entity assumes distinct liability for its respective operational obligations to you.
THIS SERVICE INCLUDES AUTO-RENEWING SUBSCRIPTIONS. BY STARTING A TRIAL OR COMPLETING A PURCHASE, YOU AGREE THAT YOUR SUBSCRIPTION WILL RENEW AUTOMATICALLY AT THE END OF EACH BILLING CYCLE UNLESS YOU CANCEL BEFORE THE RENEWAL DATE. FOR SUBSCRIPTIONS PURCHASED ON OUR WEBSITE, YOU MAY CANCEL AT ANY TIME IN YOUR ACCOUNT AND CANCELLATION TAKES EFFECT IMMEDIATELY. FOR SUBSCRIPTIONS PURCHASED THROUGH THE APP STORE OR GOOGLE PLAY, THOSE PLATFORMS REQUIRE CANCELLATION AT LEAST 24 HOURS BEFORE RENEWAL.
IF YOU DO NOT CANCEL IN TIME, THE APPLICABLE FEE WILL BE CHARGED TO YOUR CHOSEN PAYMENT METHOD. DELETING THE APP OR YOUR ACCOUNT DOES NOT CANCEL YOUR SUBSCRIPTION. TO STOP RENEWAL, CANCEL IN YOUR ACCOUNT SETTINGS ON THE APP STORE, ON GOOGLE PLAY, OR IN YOUR ACCOUNT ON OUR WEBSITE, DEPENDING ON WHERE YOU SUBSCRIBED. IF YOU DELETE YOUR ACCOUNT WHILE A SUBSCRIPTION IS ACTIVE, WE WILL CANCEL THAT SUBSCRIPTION AT THE SAME TIME UNLESS YOU TELL US OTHERWISE.
These Terms include a Binding Arbitration Provision that significantly impacts your legal rights. If you are resident in the United States, that provision requires disputes or claims arising from or related to these Terms or our Service to be resolved through arbitration on an individual basis, subject to the exceptions set out therein. If you are resident in the European Economic Area, the United Kingdom or Switzerland, the arbitration provision does not apply to you: you may bring proceedings in the courts of your country of residence, and these Terms do not deprive you of the protection of the mandatory consumer law of that country
Additional Key Provisions:
CLASS ACTION WAIVER: The section headed “Dispute Resolution by Binding Arbitration” includes a waiver of your right to participate in class actions or other collective proceedings.
DISCLAIMERS OF WARRANTIES: The section headed “Warranty Disclaimer” contains disclaimers regarding warranties related to our Service.
LIMITATION OF LIABILITY: The section headed “Limitation of Liability” outlines the limitations on our liability for damages or losses.
It is essential that you carefully review all sections of these Terms to fully understand your rights and obligations. By accessing, downloading, installing, or using any part of our Service, you confirm that you have read, understood, and agreed to be bound by these Terms.
IF YOU DO NOT AGREE TO THESE TERMS (INCLUDING BUT NOT LIMITED TO BINDING ARBITRATION PROVISION), YOU MUST NOT ACCESS OR USE OUR SERVICE. CONTINUED USE OF THE SERVICE CONSTITUTES YOUR ONGOING AGREEMENT TO THESE TERMS.
We may change these Terms where we have a valid reason to do so, including to reflect a change in law, in the Service, or in how we operate. We will post the updated version within our Service and revise the “Effective Date” accordingly. If you have an active paid subscription, we will also notify you of any material change by email or other durable medium in a reasonable time before it takes effect, and the change will apply from the start of your next billing period.
If you do not agree with an updated version of these Terms, you may cancel your subscription before the change takes effect. We encourage you to regularly review these Terms for updates.
Our Service helps you write your own memoir. You answer a set of guided questions in a private online workspace, you can type or dictate your answers, add photographs and ask us to help refine your text, and when your book is long enough we print it as a hardcover volume and ship it to you. You are the author. We provide the questions, the tools and the printing; everything you write and every photograph you add is yours.
By using our Service, you acknowledge and agree to the following disclaimers:
What the Service is, and is not. We provide a writing tool and a printing service. We do not verify, research or fact-check anything you write, and we take no position on whether what you write is accurate. Your book is your own account of your life. Writing a memoir can bring up difficult memories. The Service is not a counselling, therapeutic, medical or legal service, and nothing in it is professional advice.
Your content is yours and we do not check it. We do not review what you write for accuracy, and we do not check whether statements you make about other people are true. You are responsible for what appears in your book.
The printed book. Your book is printed to order. Page count depends on how much you write and how many photographs you include, and the figures we show you are estimates produced by the layout process, not promises. Printed colours, paper and binding may differ slightly from what you see on screen, and photographs you supply at low resolution may print poorly.
Guided questions. The guided questions are prompts, not a required order or a complete framework. You can answer them in any order, skip them, or add your own questions.
Third-Party Integrations. Some Content within the Service may reference or link to third-party sources, websites, or publicly available information. Additionally, certain features may involve third-party tools or service providers. We do not control the accuracy, availability, or privacy practices of third-party services or Content. Your use of third-party services may be subject to their respective terms and policies.
Your Responsibility. You are responsible for deciding how to use and engage with the Service and its Content. We do not guarantee that you will finish your book, or that it will reach any particular length, within any particular time. There is no deadline
Our Service is intended for individuals aged 18 or older, or the minimum age required by applicable law. We do not knowingly allow children to register for or use our Service. If you become aware that a child is using our Service in violation of these Terms, please contact us via support@oncely.app, and we will take necessary actions to address the issue.
To use and fully access our Service, you may be required to create an account (“Account”). By doing so, you agree to provide accurate, current, and complete information and to promptly update any changes to your information. If you create an Account or use our Service on behalf of another person or entity, you confirm that you have the authority to accept these Terms on their behalf.
You accept full responsibility for any actions or activities conducted under your Account, whether through your computer, mobile device, or other means. Your login credentials, including your username and password, are strictly for personal use and must be kept secure and confidential. Sharing your login credentials with others is expressly prohibited, and any breach of this obligation may result in suspension or termination of your Account.
If you suspect unauthorized access to your Account or any security breach, you must notify us immediately via support@oncely.app.
Certain features of the Service are available exclusively through a paid subscription. We offer subscription plans on a weekly, monthly, and annual basis, as well as any other billing intervals we may introduce from time to time. Subscriptions may be purchased through the Apple App Store, Google Play, or directly through our websites using the payment methods available at checkout, which may include credit and debit cards, PayPal, Apple Pay, and Google Pay. The price shown to you at checkout is the total amount payable, inclusive of any applicable value added tax or sales tax, in the currency stated at checkout.
We may offer promotional or discounted pricing from time to time. Unless expressly stated otherwise, any promotional rate may apply to the current billing period, any future billing periods, and any renewal (rebilling) periods, and may be modified or withdrawn at our discretion. Your subscription does not entitle you to any features, functionality, or content not yet made available, and your purchase is not contingent on any future updates or releases.
Where a trial period is offered, this will be clearly communicated to you before you complete your purchase. The trial notice will state: (i) whether the trial is free or paid; (ii) the duration of the trial; (iii) the full subscription fee that will apply upon conversion; (iv) the date on which your payment method will first be charged; and (v) how to cancel before the trial ends. If no trial is stated at the point of purchase, your subscription begins and is charged immediately. We reserve the right to limit your eligibility for trial offers. If we determine that a trial is being accessed in a manner inconsistent with these Terms, we may cancel the trial and charge the applicable subscription fee immediately.
UNLESS YOU CANCEL YOUR TRIAL BEFORE IT ENDS (FOR APP STORE AND GOOGLE PLAY PURCHASES, THOSE PLATFORMS REQUIRE CANCELLATION AT LEAST 24 HOURS BEFORE THE TRIAL ENDS), YOUR SELECTED PAYMENT METHOD WILL AUTOMATICALLY BE CHARGED THE APPLICABLE SUBSCRIPTION FEE DISPLAYED AT THE TIME OF PURCHASE. THE PAID SUBSCRIPTION WILL BEGIN IMMEDIATELY UPON THE TRIAL’S EXPIRATION AND WILL CONTINUE ON A RECURRING BASIS UNLESS CANCELLED IN ACCORDANCE WITH THESE TERMS.
How renewal works. Your subscription renews automatically at the end of each billing cycle (weekly, monthly, annually, or as selected at purchase) unless you cancel before the renewal date in accordance with the section headed “Subscription Terms and Renewals”. By subscribing, you authorise us, or our merchant of record partner, where applicable, to charge your payment method for each renewal period at the then-current subscription fee without further action from you.
Renewal charge timing. For subscriptions purchased on our website, a cancellation takes effect when you submit it and no further renewal charge will be made. For subscriptions purchased through the App Store or Google Play, a cancellation submitted less than 24 hours before a scheduled renewal may not take effect until after that renewal has been processed, in which case you will retain access through the end of the period for which you have been charged. This 24-hour limitation does not apply where you are exercising a statutory cancellation right that entitles you to cancel with immediate effect or to a refund.
Renewal reminders. Where required by applicable law, we will send you a reminder before your subscription renews. If you do not receive the required notice, please contact us at support@oncely.app before the renewal date.
Pricing and Fee Changes. We may change our subscription fees at any time. We will use reasonable efforts to notify you of any fee change before it takes effect. The updated fee will apply from the start of the next billing period following the change. If you do not accept the new fee, you must cancel your subscription before the start of that billing period to avoid being charged at the new rate. Promotional discounts apply to the initial payment only and do not affect subsequent renewal fees unless expressly stated.
Authorisation. By subscribing or completing a purchase, you authorise us, or our merchant of record partner, where applicable, to charge your selected payment method at checkout or, where a trial applies, at the end of the trial period, and to charge it again automatically at the start of each renewal period in accordance with the section headed “Subscription Terms and Renewals”. You represent and warrant that you are authorised to use the payment method you provide and agree to keep your billing information accurate and up to date..
Platform billing. If you purchase or activate a subscription through the Apple App Store or Google Play, all billing is handled directly by Apple or Google respectively. Charges will appear on your App Store or Google Play account statement. We do not have access to your payment details in these cases, and all billing questions relating to platform purchases must be directed to Apple or Google.
Website billing. If you purchase a subscription directly through our website, payment will be processed through our authorised payment processor or merchant of record partner using the method selected at checkout.
Failed payments. If your payment method is declined, expires, or is otherwise unavailable, we will notify you and may retry the charge. If payment is still not received, we may suspend your access to the paid features until valid billing details are provided
Validation charge. We may ask your bank to place a temporary authorisation hold on your payment method to verify that it is valid. This is not a charge and we do not receive the amount. Your bank releases the hold, usually within a few days.
Payment Disputes. If you believe a billing charge is incorrect, you must notify us in writing at support@oncely.app within fourteen (14) calendar days from the transaction date. Failure to do so may result in forfeiture of your right to dispute the charge.
Depending on your country of residence, you may have a statutory right to cancel your subscription within a specified period and receive a full or partial refund. These rights exist independently of and in addition to any contractual terms we set out, and nothing in these Terms limits or excludes them.
If you are resident in an EU member state or the United Kingdom, you have a 14-day right to withdraw from your contract, beginning on the day the contract is concluded, without giving a reason. The subscription is supplied as a digital service. If you asked us to begin supplying it during the withdrawal period, your right of withdrawal is not lost when supply begins: you may still withdraw within the 14 days, and you will pay only a proportionate amount for the part of the Service supplied up to the moment you told us you were withdrawing. We will reimburse the balance to your original payment method within 14 days of being informed of your decision.
Your printed book is treated separately. A printed book is made to your specifications and clearly personalised, so the 14-day right of withdrawal does not apply to it once you have placed a print order and we have begun producing it. Before you place a print order we will tell you that this is the case and ask you to confirm it. Your rights if the book arrives damaged, defective or not at all are unaffected.
If you are resident in Brazil or Quebec, Canada, you have a 7-day cancellation right from the date of contracting. You are entitled to a full refund.
If you are resident in Argentina, you have a 10-day withdrawal right from the date of contracting. You are entitled to a full refund.
If you are resident in Mexico, you may cancel your subscription at any time by using the immediate cancellation mechanism described in this section. You are entitled to a full refund.
Argentina — ARREPENTIMIENTO right. If you are resident in Argentina, you may exercise your 10-day withdrawal right at any time within 10 days of contracting by using the clearly labelled withdrawal mechanism available on our homepage, by submitting a request at support@oncely.app or by accessing the Ventanilla Única Federal de Defensa del Consumidor at this link.
To exercise any of the statutory rights described above, please contact us at support@oncely.app or use the cancellation method applicable to your purchase as further described in this section. We will process your request without undue delay and, where a refund is due, return the amount to your original payment method within the period required by the law of your jurisdiction.
You may have further rights under the law of your country of residence. Nothing in these Terms limits or excludes them.
App Store or Google Play Purchases: If you purchased your subscription through the Apple App Store or Google Play, all refund requests must be directed to Apple or Google respectively. Each platform manages billing and refund decisions for purchases made through it. We will help you with a platform refund request where we are able to do so, and nothing in this paragraph affects the rights you have under the law of your country of residence. Please refer to Apple's or Google's own refund and support pages for the applicable process.
Website purchases. Outside of the statutory rights set out in this section, refunds for subscriptions purchased directly through our website are limited. Where the Service does not work as it should, you are entitled to the remedies available under the law of your country of residence. These may include having the Service brought into conformity, a reduction in price, or ending the contract and receiving a refund. Please contact us at support@oncely.app and we will respond accordingly. Separately from those rights, we may offer a refund at our discretion in other circumstances; a discretionary refund is not an admission and does not limit your statutory rights.
Printed books. A printed book is made to your order and is personal to you, so we cannot resell it, and we do not accept returns of printed books except under the damage, defect and loss commitment in the section headed “Your Book: Writing, Printing and Delivery”, or where the law of your state or country gives you a right to return it.
Refund Processing. Where a refund is approved, it will be credited to the payment method you used for the original transaction. Please allow up to fourteen (14) calendar days for the credit to appear in your account, as processing times vary depending on your bank or payment provider. Only one refund will be issued per transaction. If you have already received a refund from us in respect of a charge, you must not simultaneously or subsequently seek a chargeback or payment reversal from your bank or payment provider for the same amount. If a duplicate recovery is obtained, we are entitled to recover the excess.
IMPORTANT: UNINSTALLING THE APP OR DELETING YOUR ACCOUNT DOES NOT CANCEL YOUR SUBSCRIPTION. RECURRING CHARGES WILL CONTINUE UNTIL YOU ACTIVELY CANCEL AUTO-RENEWAL USING ONE OF THE METHODS BELOW. YOU MUST CANCEL BEFORE THE START OF YOUR NEXT BILLING PERIOD TO AVOID BEING CHARGED FOR THAT PERIOD.
To avoid being charged for the next billing cycle, you must cancel your subscription before the current billing period ends. Where you are exercising a statutory right, the cancellation rules specific to your jurisdiction apply, and you may be entitled to cancel with immediate effect or with a refund regardless of where you are in the billing cycle.
For Website Purchases: You can cancel at any time in your account on our website or by contacting us at support@oncely.app. Cancellation takes effect as soon as you submit it, we will confirm it to you by email, and you keep access until the end of the period you have already paid for.
For App Store Purchases: If you subscribed or started a trial through the App Store, manage your subscription settings within your Apple Account. Ensure cancellation is completed at least 24 hours before the trial or current subscription term ends. For more information, visit Apple’s support page on managing subscriptions.
For Google Play Purchases: If you subscribed or started a trial through Google Play, manage your subscription settings within your Google Account. Cancellation must be done at least 24 hours before the trial or current subscription term ends. Learn more about managing subscriptions on Google’s support page.
EU and UK — withdrawal button. If you are resident in an EU member state, a withdrawal function is available in your account throughout the 14-day withdrawal period. Selecting it takes you to a confirmation function, and we will acknowledge receipt of your withdrawal on a durable medium without delay. You may use it at any time during the 14-day period without giving a reason. If you are resident in the United Kingdom, you may cancel using the cancellation control in your account or by contacting us. To exercise your right of withdrawal, where applicable, you must send an unequivocal statement of your intention to withdraw from the contract (i.e., these Terms). This can be done by:
Extramile Limited, Prodromou, 75, Oneworld Parkview House, Floor 4, 2063, Nicosia, Cyprus
Fulfilling Inc., 1007 N Orange St., 4th Floor, Ste 1382, Wilmington, New Castle, DE 19801, USA
The withdrawal period expires fourteen (14) calendar days from the day you entered into the contract, and we will accept a withdrawal notice submitted at any time up to the end of that period. While not mandatory, you may use the following template to exercise your right of withdrawal:
I/we* hereby withdraw from the contract concluded by me/us* for the purchase of the following goods*/the provision of the following service*:
Ordered on*/received on*:
Name of the consumer(s):
Address of the consumer(s):
Date:
*Delete as applicable.
User Acknowledgment and Responsibilities. By using the Service, you acknowledge and agree that certain features of the App require access to specific permissions on your device. Your device will ask for your permission before any such access, and you can change or withdraw permission at any time in your device settings. If you do not grant a permission, the related feature may be unavailable or limited; the rest of the Service will continue to work
Your Representations and Warranties. By accessing or using the Service, you represent, warrant and agree that:
Your Permitted Use of the Service. We allow you to use the Service for your personal, non-commercial purposes. This restriction applies to the Service itself and to our questions, templates and designs. It does not apply to your book: your book is yours, and you may do what you like with what you have written, including publishing it or selling it, using a print file or copies you obtain from us.
Your Prohibited Use of Service. You agree not to use the Service, directly or indirectly, for any unlawful or unauthorized purposes, or in a manner that violates these Terms, including but not limited to:
Right to Refuse or Terminate Access. We reserve the right, at our sole discretion, to refuse, restrict, suspend, or terminate your access to the Service, in whole or in part, at any time and without prior notice, if we determine that: (a) any information you have provided is false, inaccurate, outdated, or incomplete; (b) you have violated or are reasonably suspected of violating these Terms, applicable laws, or the rights of any third party; (c) your conduct may harm us, our affiliates, users, or partners; or (d) your use of the Service poses a security, operational, reputational, or legal risk.
We further reserve the right to refuse the creation of new accounts or to block access from specific devices, IP addresses, or user credentials to protect the integrity and security of the Service. Where we suspend or restrict your access, we will tell you why unless we are prevented from doing so by law, and give you an opportunity to respond. If we withdraw the Service, or end your access for a reason other than your breach of these Terms, we will refund the amount you have paid for any period falling after that date
Termination or suspension shall not limit or affect any other remedies available to us under applicable law or equity.
What your subscription includes. A private writing workspace you can reach through a web browser on a computer, tablet or phone; a set of guided questions on the topic you selected; tools to type or dictate your answers, add photographs and refine your text; and, once your book meets the minimum length described below, one printed hardcover copy of that book shipped to an address in the United States. Additional printed copies and any add-on products are sold separately at the prices shown when you order them.
The included printed copy is used once. Your subscription includes one printed copy of your book. Once we have sent your book to print, that included copy has been used. Any further printing of the same book, including a revised edition after you continue editing, is charged at our then-current prices for additional copies. Renewing your subscription does not give you another included copy.
Minimum length. Before you can order printing, your book must contain answers to at least ten (10) chapters and reach approximately 100 pages when laid out. We show your progress as you write. Page count depends on how much you write and how many photographs you include, and is an output of the layout process rather than a promise.
AI text refinement. If you ask us to, we send the text you select to a third-party large-language-model provider with instructions to correct grammar and improve structure without adding facts. We show you your original and the refined version side by side and you choose which to keep. We always keep your original text. You decide what goes in your book.
What refinement will not do. Refinement is a language tool, not a fact-checker. It can change your meaning, introduce errors, or produce text that does not say what you intended. You are responsible for reading a refined version before you accept it, and we do not warrant that it is accurate or faithful to your original.
Voice dictation. You can record audio in your browser. We stream it to a third-party speech-to-text provider, which returns text.
Recording other people. Dictation is intended for your own voice. If anyone else can be heard on a recording, you are responsible for having their permission. Do not record another person without their knowledge.
Photographs. You may add up to three photographs per chapter and up to 135 per book, in JPG, PNG or HEIC format. We convert and resize them on our servers and store them privately. If a photograph is too low in resolution to print well we will warn you, but we will not prevent you from using it, and we are not responsible for how it prints once you have been warned.
Your rights in what you upload. You are responsible for having the rights to every photograph you add and for the people who appear in it. Do not upload a photograph you do not own or have permission to use, and do not upload a photograph of another person, including a child, unless you have the right to do so.
Your content stays private. Your writing and your photographs are private to you. The only people who see them are you and the members of our staff who need to for support or for the print review. We will not use your content, your name, or your likeness in advertising unless you separately agree at the time.
What you must not include. You must not include in your book any content that is unlawful, promotes or facilitates unlawful activity, infringes or misappropriates another person's intellectual property or other rights, violates any applicable privacy or publicity rights, contains personal or confidential information without the necessary authorization, includes photographs, images or other materials that you do not have the right to use, is defamatory, threatening, harassing, abusive or discriminatory, promotes violence or terrorism, facilitates fraud or other criminal activity, contains sexual content involving minors or the sexual exploitation of minors, or otherwise violates applicable law or the content, safety or printing standards of our print vendors.
Print review. When you order printing we generate a print file and a member of our staff reviews it before it is sent to our print vendor. The review checks the layout and looks for obvious problems of the kinds listed above. We do not edit your words, correct your writing, or make judgements about the content of your life story.
If we cannot print your book. If the review identifies a problem we will tell you what it is and give you the opportunity to change the relevant part and order again. We will not print a book that breaches the standards above. A refusal to print does not end your subscription and does not by itself entitle you to a refund of subscription fees.
Our print vendor's own rules. Our print vendor applies its own content standards (https://www.lulu.com/terms-and-conditions) and may itself decline to print a book. Where that happens we will tell you.
Our print vendor. To print your book we send our print vendor the print file containing your text and photographs, together with your name, shipping address and telephone number. Our current print vendor is Lulu Press Inc, in the United States (https://www.lulu.com/). The links we give the vendor to your file expire after a short period. We may use additional or different print vendors, and will keep this section up to date.
Ordering printing. When your book meets the minimum length you can place a print order. We generate a print file, a member of our staff reviews it and we then send it to our print vendor. While your book is in production it is locked for editing. After your copy has been delivered you can reopen your book, continue editing and order further copies.
Delivery estimates. Our print vendor prints in the United States and ships with tracking. We will give you an estimated delivery date when you place your print order. It is an estimate based on normal production and carrier times, not a guarantee, and it does not affect your rights.
Shipping time and your right to cancel a print order. We will ship your printed book within the time we state to you when you place the print order or, if we state no time, within thirty (30) calendar days of that order. If we cannot ship within that time we will tell you before it expires, give you a revised shipping date or tell you that we cannot estimate one, and offer you the choice of agreeing to the delay or cancelling your print order for a prompt refund. If we cannot give a revised date, or the delay is longer than thirty (30) calendar days, and you do not tell us that you still want the book, we will cancel the print order and refund you.
We ship within the United States only. You are responsible for giving us a complete and accurate shipping address.
Title and risk. Title to and risk in a printed book pass to you when it is delivered to the address you gave us.
If your book arrives damaged, or does not arrive. This is our limited warranty on printed books. If a printed book arrives damaged, misprinted or otherwise defective, tell us within five (5) calendar days of delivery and send photographs showing the problem. If tracking shows your book as delivered but you have not received it, tell us and we will wait seven (7) calendar days and then arrange a replacement. If tracking shows the book as lost in transit, we will arrange a replacement straight away. This commitment is in addition to any rights you have under the law of your country or state of residence.
What happens if your subscription ends. If your subscription lapses or you cancel it, you keep everything you have written, in read-only form. You can still read your book, order printing of a book that already meets the minimum length, and order additional copies. Editing, voice dictation and AI refinement require an active subscription.
If the Author dies or loses capacity. Many people write their life story so that it outlives them. This section explains what happens to an account and a book if the author dies or becomes unable to manage their own affairs. We will deal with the executor or personal representative of the author's estate, or with a person holding a valid power of attorney or equivalent authority. On satisfactory proof we will support@oncely.app. We will not hand over account login credentials to anyone, including a personal representative.

THIS SECTION OUTLINES YOUR RIGHTS AND OBLIGATIONS REGARDING DISPUTE RESOLUTION. PLEASE READ IT CAREFULLY, AS IT INCLUDES MANDATORY BINDING ARBITRATION. THIS SECTION SHALL BE REFERRED TO AS THE “ARBITRATION AGREEMENT”
For Users in the European Union, United Kingdom, Liechtenstein, Switzerland, Norway, or Iceland. If you reside in the European Union, United Kingdom, Liechtenstein, Switzerland, Norway, or Iceland, any Disputes arising out of or relating to these Terms, including their interpretation, enforcement, or validity, shall be governed by and construed in accordance with the laws of your country of residence. The courts of your usual place of residence shall have exclusive jurisdiction over any Disputes (as defined herein) that are not resolved through the Arbitration Agreement outlined in these Terms.
For Residents of the State of California Only:
Notwithstanding any provision to the contrary in this Arbitration Agreement or the Terms, if you are a consumer residing in California, the following terms shall apply with respect to any Disputes arising out of or relating to your access to or use of the Service, or to these Terms:
Venue: All disputes between you and us will be resolved exclusively through binding arbitration conducted in the State of California and administered by the American Arbitration Association (AAA) in accordance with its applicable rules. The arbitration shall be held at the AAA offices in San Francisco, California, or at another location in California mutually agreed upon by the parties, or as determined by the AAA to be reasonably convenient for you. Where permitted, the arbitration may also be conducted remotely by video, telephone, or other means in accordance with the AAA Rules and applicable law.
Governing Law: All arbitration proceedings shall be governed by the substantive laws of the State of California, regardless of any conflicting choice of law provision elsewhere in these Terms.
Right to Void Certain Provisions: Pursuant to California law, any clauseany clause that requires arbitration to be held outside California or applies another state’s law to disputes arising within California is voidable at the consumer’s request. If such a provision is voided, the dispute must be adjudicated in California and governed by California law.
Applicability of Arbitration Agreement (California Residents). Except as expressly modified by this California Consumer Arbitration Notice, all other provisions of the Arbitration Agreement contained in these Terms shall continue to apply in full force and effect. In the event of any conflict between the Arbitration Agreement and applicable California law, the provisions required by California law shall prevail solely for California residents. All remaining provisions of the Arbitration Agreement shall be interpreted and enforced consistent with California law to the maximum extent permissible.
For Users in the United States or Other Jurisdictions. If you reside in the United States or any other jurisdiction not specifically covered above, any Disputes arising out of or relating to these Terms shall be resolved exclusively through the Arbitration Agreement set forth herein, subject to applicable law. The governing law and venue for arbitration shall be as specified in the Arbitration Agreement, except for California residents, for whom the arbitration will be conducted in accordance with California law and in a venue within California, as outlined in the “California Consumer Arbitration Notice” section of these Terms. All other provisions of the Arbitration Agreement remain fully applicable to California residents to the extent permitted by law.
Notwithstanding the above, the following exceptions apply:
Small Claims Court: Either party retains the right to bring an individual claim in small claims court for disputes or claims within the jurisdictional limits of such a court.
Injunctive or Equitable Relief: Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect or enforce intellectual property rights, including copyrights, trademarks, trade secrets, patents, or similar proprietary rights.
BY ACCEPTING THESE TERMS, YOU EXPRESSLY AGREE, AND WE AGREE, TO WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE WAIVER OF CLASS ACTIONS AND COLLECTIVE RELIEF IS A FUNDAMENTAL COMPONENT OF THIS ARBITRATION AGREEMENT. ALL CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS. YOU ACKNOWLEDGE AND AGREE THAT THIS ARBITRATION AGREEMENT LIMITS YOUR RIGHT TO APPEAL AND OTHER RESOLUTION PROCESSES.
You further agree that all disputes between you and us will be resolved exclusively through binding arbitration before a single, neutral arbitrator, administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (the “AAA Rules”) then in effect, except as modified herein. We maintain registration of this arbitration clause on the AAA Consumer Clause Registry and pay the applicable annual registry fee.
Place of Arbitration. The arbitration will be held in the county of your residence, or remotely by video or telephone at your election, unless the parties agree otherwise.
Governing Law. The arbitration shall be conducted in accordance with the laws of the State of Delaware, consistent with the Federal Arbitration Act, including any applicable statutes of limitations and recognized legal privileges.
Language of Arbitration. The arbitration will be conducted in the English language.
Commencing Arbitration. To initiate arbitration, you must adhere to the procedures outlined by the AAA Rules, which are accessible on this page.
Informal resolution first. Before commencing arbitration, the party raising a Dispute will send the other a written notice describing it and the relief sought, and the parties will try in good faith to resolve it for sixty (60) calendar days. Any applicable limitation period is suspended during that time.
Mass filings. Where twenty-five (25) or more similar demands for arbitration are filed against us by or with the assistance of the same counsel or coordinated group, the parties will follow the AAA rules applicable to multiple case filings, including the appointment of a process arbitrator and the batching of cases.
Selection of the Arbitrator. The arbitrator responsible for adjudicating the dispute will be selected in accordance with the procedures specified in the AAA Rules.
Hearing Requirements. For claims of $10,000 or less, the arbitration will generally proceed on the basis of written submissions from the parties, unless a hearing is requested by you or deemed necessary by the arbitrator. For claims exceeding $10,000, the need for a hearing will be determined by the AAA Rules. The arbitrator shall have the discretion to oversee and regulate the exchange of information between the parties. No party or representative shall engage in ex-parte communications with the arbitrator. All communications must be made in the presence of, or with notice to, all parties involved in the arbitration.
Judgment and Finality of Award. The arbitrator shall deliver the award within the timeline prescribed by the AAA Rules. The award may be enforced in any court with appropriate jurisdiction. The arbitration award shall be final and binding, and there shall be no appeal. Any damages awarded by the arbitrator must conform to the limitations specified in the applicable “Limitation of Liability” section, including restrictions on the types and amounts of damages recoverable.
Remedies. The arbitrator shall have no authority to award punitive or other damages not measured by the prevailing party's actual damages, except as may be required by statute.
Individual Relief Only. The arbitrator may award relief solely in favor of the individual party seeking relief and only to the extent necessary to resolve that party's individual claim. The arbitrator shall have no authority to award relief to or against anyone who is not a party to the arbitration. Furthermore, the arbitrator may not consolidate multiple parties' claims or preside over any form of class, joint, or representative proceeding.
Fees. Your obligation to cover any filing, administrative, or arbitrator fees shall be governed exclusively by the fee schedule outlined in the AAA Rules.
Assessment of Fees. We will not seek an award of our attorney fees against you. The arbitrator may award you your reasonable attorney fees where applicable law provides for them. The allocation of forum fees and expenses shall be determined by the arbitrator.
Confidentiality. Except as may be required by law, neither we nor the arbitrator will disclose the existence, content or results of any arbitration without your prior written consent. You are not required to keep the arbitration confidential.
Opt-Out Option. You may opt out of this Arbitration Agreement within thirty (30) calendar days of accepting these Terms by submitting your notice via support@oncely.app, stating your intention to opt out. Opting out will not affect other provisions of these Terms.
Severability. If any portion of this Arbitration Agreement is deemed invalid or unenforceable, that portion shall be severed, and the remaining provisions shall remain in full force and effect. However, if the waiver of class actions and collective relief is found unenforceable, the arbitration shall proceed on an individual basis only to the fullest extent permitted by law.
Survival. Except stated otherwise, this Arbitration Agreement shall survive termination of these Terms.
Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware without regard to its conflict of laws principles, and excluding the 1980 UN Convention on Contracts for the International Sale of Goods. If you are resident in the European Economic Area, the United Kingdom or Switzerland, these Terms are governed by the law of your country of residence and you may bring proceedings in its courts. If you are resident elsewhere outside the United States, you may bring proceedings in the courts of your country of residence or, at your election, in Cyprus.
Entire Agreement. These Terms constitute the entire agreement between you and us regarding your access to and use of the Service and supersede all prior agreements, understandings, or representations, whether written or oral.
No Waiver. Failure or delay by us to exercise any right or enforce any provision under these Terms shall not operate as a waiver of such right or provision. A waiver will only be effective if explicitly stated in writing and signed by an authorized representative.
Severability. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified or severed to the minimum extent necessary to comply with the law, without affecting the enforceability of the remaining provisions.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms at any time and without prior notice, including via novation. Posting an updated version of these Terms identifying the new party shall serve as valid notice of such transfer. These Terms are binding and will inure to the benefit of both parties and their respective successors, assigns, and legal representatives.
Electronic Communications. By interacting with the Service or communicating with us electronically, you consent to receive communications electronically and agree that such communications, including notices, disclosures, and agreements, have the same legal effect as those provided in writing. You acknowledge that your electronic submissions constitute a legally binding agreement.
Force Majeure. We shall not be held liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, governmental actions, labor disputes, or disruptions in telecommunications.
